In general, the filibuster is a US Senate tool used by the minority to express its view and exercise its power in the consideration of legislation and nominations. In the past, a Senator filibustered by speaking while standing before the Senate; he could only be silenced by a vote of sixty Senators. Now we have what is called a "silent filibuster," where a Senator can declare a filibuster without revealing his identity or being required to speak. Whenever this is done the level of votes required to pass the legislation under consideration, rises to sixty votes. As it stands now, a minority of forty-one Senators can sink any legislation merely by declaring an intention to filibuster. The conservatives have used this weapon often. The liberals cry because the bad-guy-conservatives keep them from passing legislation that the people want. Since the democrats have controlled the Senate for the last five years, why haven't they changed the filibuster rule? The simple answer is that both parties love it. The minority republicans please their base by stopping legislation they don't approve of, and the democrats please their base by showing their good intentions. The only winners are the wealthy who finance both parties.

Over the last 2 years Republicans have obstructed the democratic functioning of the Senate by putting an inordinate amount of holds on President Obama's nominees for judges and other offices. Republicans have instituted the filibuster on more bills than any other Congress in the history of the country. In effect Republicans have been holding America hostage with their 41 votes.
